1) Scope of application
These General Terms and Conditions apply between the Job Exchange of the Career Center of BTU Cottbus-Senftenberg (hereinafter referred to as "Job Exchange"), located in Cottbus, and its respective client. These General Terms and Conditions shall apply exclusively. We hereby object to any general terms and conditions of business of the client that conflict with or deviate from our terms and conditions of business.
2) Registration
2.1) General information
In order to be able to use the services of the job exchange to the full extent, registration with the job exchange must take place. The registration takes place at www.jobs.hl-careercenter.de. When registering, the customer must specify a user name and password. Fictitious names and similar are not permitted.
The Job Exchange reserves the right to refuse the registration of individual persons or companies for good cause. In particular, insolvency, deception about significant facts and if the customer violates the contractual regulations or violates the applicable law are considered as good cause.
In addition, users of the job exchange and their job offers and job applications can be blocked if the reputation of the BTU Cottbus-Senftenberg is damaged by the job offer or job application. This also applies if the advertisement promotes a study or further education program competing with BTU Cottbus-Senftenberg.
2.2) Students - Registration
Registration and use of the job exchange is free of charge for students.
2.3) Company - Registration
Registration and use of the job exchange is free of charge for companies.
3) Obligations of the customer
The customer is responsible for the correct entry and modification of his data.
The customer may publish a maximum of 50 job advertisements per year. It is not allowed to create several customer accounts to circumvent this regulation.
The customer may only publish job advertisements that require a university degree. The only exception to this rule are part-time jobs.
In the course of publishing job advertisements via the job exchange, the customer selects the respective courses of study precisely, i.e. matching the respective job advertisement. The publication of job advertisements for "all courses of study" is only permitted if the job is actually suitable for all courses of study.
The customer may post the same job offer on the job exchange no more than once a month.
The customer may not pass on his password to third parties and must keep it protected from access by third parties. If there is reason to suspect that unauthorized persons have gained knowledge of the password, the customer must change the password immediately. Any kind of disclosure of profile data to third parties is prohibited. In digital media, the password may only be stored in encrypted form.
4) Violation of customer obligations and third party rights by the customer
In the event of significant violations of the obligations incumbent upon the customer, the Job Exchange shall be entitled to block the Job Exchange account or an individual Job Exchange service. The Job Exchange shall inform the customer of the reason for the block. The blocking shall continue until the breach of duty has been remedied and/or the customer has made a credible case for refraining from future breaches of duty. In the event of justified suspicion of a significant breach of duty, the Job Exchange shall be entitled to block the Job Exchange account or individual Job Exchange services until the suspicion has been clarified.
The Job Exchange shall not be liable for damages resulting from a breach of duty for which the Customer is responsible or which could have been prevented if the Customer had complied with the duties. In the event of a violation of the rights of third parties for which the customer is responsible, the customer shall be directly liable to such third parties. In the event of justified claims by third parties based on such an infringement, the Customer shall be obliged to indemnify the Job Exchange against liability, unless the Customer proves that it is not responsible for the breach of duty that caused the damage. These provisions shall also apply if the customer violates duties arising from special contractual conditions.
5) Warranty
The Job Exchange does not guarantee the correctness of the content of all entries on the Job Exchange. However, the Job Exchange endeavors to prevent misuse and to cleanse the database as far as possible of false information.
6) Data processing
In the context of statistical evaluation, data on profile views and creation of entries are stored and evaluated in the database. By confirming the General Terms and Conditions, the customer declares that all his entries are publicly accessible within the scope of job placement. Data about user behavior will only be published anonymously.
7) System requirements
The customer requires a Windows operating system from Windows 2000/XP/Vista/7; as well as Internet Explorer from version 6.0 (or comparable browsers) and access to the Internet site www.jobs.hl-careercenter.de . Java script must be activated for individual functions of the job exchange.
